Sri Lanka has made a notable advancement in bolstering business confidence by launching a contemporary framework for commercial mediation. This initiative aims to create an organized, efficient, and internationally compatible system for companies to settle disputes, all while safeguarding important business relationships.
This achievement was celebrated at the first Corporate Mediation Pledge Ceremony, hosted by the International Alternative Dispute Resolution Center (IADRC) at the Sales Gallery in Port City Colombo. During the event, twenty-five corporations pledged to acknowledge mediation as a viable option for resolving conflicts that may arise in their business activities.
The initiative aligns with the implementation of the Mediation (Civil and Commercial Disputes) Act, No. 13 of 2026, which became effective on June 30, 2026. This legislation marks a significant policy development by endorsing mediation as a recognized method for resolving civil and commercial disputes. It establishes standards for the mediation process, outlines the responsibilities of mediators and mediation service providers, and lays out a framework for the acknowledgment and enforcement of mediated settlement agreements.
The introduction of this framework provides businesses with an innovative avenue for resolving commercial disputes in a manner that prioritizes confidentiality, collaboration, and practical solutions. Unlike traditional dispute resolution methods, which can lead to lengthy proceedings, mediation allows parties to engage directly, seek mutually beneficial resolutions, and maintain crucial commercial relationships that might otherwise be jeopardized by conflict.
